§ 1 Provider & Contracting Party

The contracting party is:

§ 2 Scope

1. These Terms and Conditions apply to all contracts that you, as the customer, conclude with us, as the provider, via the website www.dietees.de.
2. Deviating, conflicting or supplementary general terms and conditions shall only become part of the contract if we have expressly agreed to their validity in writing.
3. A consumer within the meaning of § 13 BGB is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to either their commercial or their independent professional activity. An entrepreneur within the meaning of § 14 BGB is any natural or legal person who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
4. The language of the contract is exclusively German.

§ 3 Conclusion of Contract

1. The subject of the contract is the sale of tea, herbal teas and tea accessories in quantities customary for household use.
2. By listing products on our website, we already make you a binding offer to conclude a contract on the terms stated in the product description.
3. The contract is concluded as follows:
   • You place the desired items in the shopping basket.
   • The "Checkout" button guides you through the ordering process.
   • After entering the required details and choosing your preferred payment method, you will receive an order overview.
   • By clicking "Order with obligation to pay" (or a comparable button), you bindingly accept our offer.
4. You will immediately receive an email confirming receipt of your order. This does not yet constitute acceptance of the contract unless acceptance is expressly stated.

§ 4 Prices & Shipping Costs

1. All prices stated are final prices and include statutory VAT (7 % for food items and 19 % for other goods).
2. Shipping within Germany is free of charge from an order value of 32,00 €. Below this order value, shipping costs of 3,50 € apply.
3. For deliveries to other EU countries, the following shipping costs apply regardless of the order value:

The shipping costs applicable to each delivery are shown transparently during the ordering process, before the order is placed bindingly.

§ 5 Payment Terms

The following payment methods are available:

• PayPal
• Credit card (Visa, Mastercard, American Express)
• Klarna (invoice, instalment payment, instant bank transfer)
• Apple Pay
• Google Pay
• Advance payment / bank transfer
• Other payment methods shown at checkout

The payment options available can be viewed and selected during the ordering process.

§ 6 Delivery & Delivery Times

1. Delivery is carried out by DHL from our warehouse in St. Leon-Rot.
2. Delivery time within Germany is generally 1–3 working days from receipt of payment or order confirmation, unless otherwise stated in the offer. For deliveries to other EU countries, delivery time is typically 3–7 working days.
3. Same-day delivery in the Walldorf region: Orders received by 13:00 will, on request, be delivered the same working day to Walldorf, Sandhausen, Schwetzingen, Oftersheim, Wiesloch, Hockenheim, Leimen, Nußloch, Reilingen, Ketsch, St. Leon-Rot and Heidelberg.
4. Should an ordered item not be available, we will inform you immediately by email.
5. For consumers, the risk of accidental loss or accidental deterioration of the goods only passes to the consumer upon handover of the goods (§ 446 BGB).

§ 7 Retention of Title

The goods remain our property until paid for in full.

§ 8 Right of Withdrawal

1. Consumers have a statutory right of withdrawal of 14 days after receipt of the goods (§ 312g BGB in conjunction with § 355 BGB).

3. You may also declare your withdrawal informally by email to info@dietees.de.

§ 9 Exclusion of the Right of Withdrawal

The right of withdrawal does not apply pursuant to § 312g (2) BGB in the case of:

• The delivery of sealed goods (food packaging) that for reasons of health protection or hygiene are not suitable for return if the seal has been removed after delivery.
• The delivery of goods that spoil quickly or whose expiry date would quickly be exceeded.
• The delivery of goods that were made to individual customer specifications.

§ 10 30-Day Taste Guarantee (voluntary)

In addition to the statutory right of withdrawal, we grant you a voluntary taste guarantee for the pack sizes 250 g and 1000 g pursuant to § 479 BGB, under the following conditions:

1. The guarantee applies exclusively to unopened, originally sealed main packages.
2. The return must be made within 30 days of receipt of the goods.
3. The return request must be sent by email to info@dietees.de stating the order number.
4. If the return is accepted, we will refund the full purchase price of the returned main package as well as the standard return shipping costs.

Detailed conditions can be found at dietees.de/geschmacksgarantie/. Your statutory warranty rights remain unaffected by this.

§ 11 Warranty & Best-Before Date (MHD)

1. The statutory warranty rights pursuant to §§ 434 et seq. BGB apply. For consumers, the warranty period is two years from receipt of the goods, but for food items it is limited by the respective best-before date (MHD) stated.
2. The best-before date is clearly displayed on each package. Within the best-before date, we guarantee the typical characteristics of our teas (aroma, taste, colour).
3. Consumers are asked to check the goods for completeness and obvious defects upon delivery. However, failure to report a defect does not affect your statutory warranty rights.
4. Please report any transport damage to us within 7 days of receipt so that we can take action against the transport service provider.

§ 12 Organic Certification & Packaging

1. All products labelled "organic" or "organic tea" come from certified organic farming and are certified in accordance with the EU Organic Regulation.
2. Certification body: DE-ÖKO-039 (GfRS Gesellschaft für Ressourcenschutz mbH).
3. Blending and packaging take place exclusively in Germany.
4. Pursuant to § 9 VerpackG, we are registered with the Stiftung Zentrale Stelle Verpackungsregister (ZSVR) under the EAR number DEDE406738497. Our packaging is licensed via a dual system.

§ 13 Data Protection & Storage of the Contract Text

1. We process your personal data exclusively in accordance with the GDPR and the German Federal Data Protection Act (BDSG). Detailed information can be found in our Privacy Policy.
2. We describe the use of cookies and similar technologies in our Cookie Policy.
3. Storage of the contract text: We send you the contract text together with the order confirmation by email. We do not otherwise permanently store the contract text with access for the customer — please save the confirmation yourself for your records.

§ 14 Customer Reviews

1. On our website, we publish customer reviews via the services Trustpilot as well as our internal review mechanism ("Manual Reviews Pro").
2. Both services ensure that only reviews from verified buyers with a proven order are published — this complies with the requirements of § 5b (3) UWG (Omnibus Directive).
3. Reviews are neither purchased nor commissioned. Negative reviews are not deleted unless they violate the law or our house rules.

§ 16 Applicable Law & Jurisdiction

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.
2. In business dealings with merchants, legal entities under public law or public special funds, Walldorf is the exclusive place of jurisdiction.

§ 17 Severability Clause

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by the applicable statutory provision.

§ 18 Gift Cards

1. Scope. These terms apply to digital gift cards (value vouchers) from DieTees delivered by email.
2. Redemption. Gift cards can only be redeemed in the DieTees online shop and for the entire product range. One gift card code can be redeemed per order.
3. Validity. Gift cards have no expiry date and are valid without any time limit.
4. Remaining balance. If the gift card value exceeds the order value, the remaining balance stays on the card and can be used for future orders.
5. No cash payout. Payment of the gift card value or any remaining balance in cash is excluded. The gift card cannot be exchanged for cash and does not bear interest.
6. Transferability. The gift card is transferable. Entering the code is sufficient to redeem it; the eligibility of the redeeming person is not checked. DieTees is not liable for loss, theft or misuse of the code unless DieTees is responsible for it.
7. No purchase of further gift cards. Gift cards cannot be used to purchase further gift cards.
8. Right of withdrawal. The statutory right of withdrawal remains unaffected. Details and exceptions (in particular for digital content) are set out in our cancellation policy.
9. VAT. The gift card is a multi-purpose voucher within the meaning of § 3 (15) UStG; VAT arises only upon redemption at the tax rate of the goods purchased.

§ 19 Last Updated & Amendments

Version of these Terms and Conditions: November 2026.

We reserve the right to amend these Terms and Conditions at any time, subject to reasonable prior notice and taking into account the customer's legitimate interests. In the event of changes, you will be informed in good time by email. For contracts already concluded, the version valid at the time the contract was concluded shall apply.
